By requesting a quote, signing a service agreement, or engaging Rocwater Pty Ltd ("Rocwater", "we", "us", or "our") to perform any pool resurfacing or interior finishing services, you ("Customer", "you") agree to be bound by these Terms of Service ("Terms").
If you do not agree with any part of these Terms, you must not engage our services. These Terms apply to all customers, both residential and commercial, across Queensland, Australia.
Rocwater provides professional pool resurfacing and interior finishing services, including but not limited to:
Service availability is subject to geographical coverage and scheduling. We primarily service the greater Queensland region, including South East Queensland, Gold Coast, Sunshine Coast, and Toowoomba areas.
All quotes provided by Rocwater are based on information supplied by the customer and a visual inspection where applicable. Final pricing is confirmed in writing prior to commencement of work.
Quotes are valid for 30 days from the date of issue unless otherwise stated. Rocwater reserves the right to revise a quote if:
Any variations to the agreed scope will be communicated and approved in writing before additional work proceeds.
Upon acceptance of a quote and receipt of a deposit (where applicable), Rocwater will schedule the project at a mutually agreed date. The following conditions apply:
Rocwater's standard completion timeframe is 3 business days from commencement, subject to weather conditions, pool size, and scope complexity. We will not be held liable for delays caused by factors outside our reasonable control, including extreme weather, equipment failure, or inaccessible sites.
Payment schedules are outlined in your individual service agreement. General terms include:
Invoices not paid within the agreed period may attract interest at a rate of 1.5% per month on the outstanding balance. Rocwater reserves the right to engage a debt recovery service for unpaid invoices.
Rocwater uses professional-grade materials and follows industry-standard installation practices. All work is performed by trained and experienced technicians.
Our workmanship warranty covers defects arising from our installation process. This warranty does not cover:
To the maximum extent permitted by law, Rocwater's total liability to any customer for any claim arising from our services is limited to the amount paid by the customer for the specific service giving rise to the claim.
We are not liable for any indirect, consequential, or economic loss, including but not limited to loss of enjoyment, inconvenience, or loss of income, arising from delays, defects, or errors in our services.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable Australian law.
All content on this website, including text, images, graphics, videos, designs, and the pool visualizer tool, are the intellectual property of Rocwater or its licensors. You may not reproduce, distribute, or use our content without written permission.
By sharing photographs or information about your project with us, you grant Rocwater a non-exclusive, royalty-free licence to use such material for marketing and promotional purposes, unless you specifically request otherwise in writing.
Your privacy is important to us. Our collection, use, and storage of your personal information is governed by our Privacy Policy, which forms part of these Terms. By engaging our services, you consent to the practices described in our Privacy Policy.
Either party may cancel a booking prior to commencement by providing written notice. The following cancellation terms apply:
Rocwater may also terminate a service agreement if the customer breaches these Terms, provides false information, or creates an unsafe working environment. In such cases, payment for work performed to date remains due.
These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland for the resolution of any dispute arising from these Terms.
